What New York law says about STD disclosure

Whether New York's venereal disease law covers herpes is unclear.

New York Public Health Law § 2307 makes it a misdemeanor for a person who knows they are infected with an infectious venereal disease to have sexual intercourse with another person. The law does not define 'infectious venereal disease'. According to the Center for HIV Law and Policy, the state health department has said, in a non-binding statement, that it reads the law as covering acute bacterial infections such as syphilis or gonorrhea.

Whatever the law says, CDC guidance is to tell partners before you start a sexual relationship. It is also the foundation of trust. Our herpes disclosure guide covers when and how.
